The stopwatch's weakness isn't that it's inaccurate — it's that it's unilateral. The warehouse scanner watching a picker's every reach, the pharmacy timer docking a pharmacist for breathing between prescriptions, the adjunct's LMS logging her login at 6:14 a.m. and 11:52 p.m.: these all share a shape. The force flows one way. The watcher sets the standard, applies the metric, and extracts the consequence. The watched receives the standard, is measured against it, and absorbs the consequence. This isn't surveillance-as-information; it's surveillance-as-architecture, designed so that one party's visibility produces another party's obedience. Privacy rhetoric misses this because privacy assumes a boundary dispute between equals. You don't need to protect your privacy from someone who can already fire you; you need to protect your leverage. The stopwatch isn't the problem. The hand that holds it, and the total absence of a hand on the other side, is.
But here's the thing about one-way force: it depends on the other side never learning to push back. Every system of unilateral control has a pressure point, and for workplace surveillance the pressure point has always been the same — the collective refusal to be measured. The individual worker can't beat the scanner. She can't game the timers fast enough, can't hide her bathroom breaks cleverly enough, can't negotiate the metrics down one-on-one. But the unit can. The unionized workforce is the counter-leverage that makes the stopwatch's hand tremble, because suddenly the cost of measurement isn't just the worker's wages — it's the shutdown of the entire operation. The scanner can watch one worker indefinitely. It cannot watch a thousand workers who have all decided, together, to stop moving until the metrics change.
This is why the surveillance industry keeps growing even as workers adapt. The algorithms get stricter, the sensors get cheaper, the dashboards get more granular — because the goal isn't to measure productivity accurately. The goal is to measure productivity visibly, so that every worker knows they're being watched and adjusts accordingly. The goal is to make the cost of resistance feel individual and immediate — your numbers, your job, your problem — rather than collective and strategic. And that's the precise point where the surveillance economy meets its own ceiling. A worker who knows her union has her back can tolerate being watched in a way a worker who's alone cannot. The fear that makes the scanner effective evaporates the moment it's shared.
The newer wrinkle — and it's worth being clear-eyed about this — is that remote work scrambled the old geography of leverage. The warehouse has a physical choke point; the delivery route has a loading dock; the factory floor has a gate. But the remote worker's "floor" is her own kitchen table, and the "gate" is a login screen. The union's traditional tools — the picket line, the sit-down, the walkout — were calibrated to physical space, and the tech industry knows it. That's why the surveillance software for remote workers is marketed so aggressively: it's an attempt to rebuild the visual architecture of control in a space where the worker was briefly out of sight. The stopwatch got smaller, and it moved into the laptop.
But the leverage didn't disappear. It just moved to a different point: the network. The remote worker can't shut down a factory floor, but she can refuse to log in. She can collectively stop answering the messages, stop meeting the response-time SLA, stop letting the keystroke counter accumulate. The electronic picket line is a real thing, and it's the only answer to the electronic stopwatch. The power that the stopwatch tries to monopolize — the power to set the pace — is still, ultimately, in the hands of the people who do the work. The scanner records the pace. It cannot set it, not really, not unless the workers consent to being paced. And consent, once withdrawn collectively, is very hard to manufacture.
So the frame I'm pushing back against is the one that treats workplace surveillance as a privacy problem to be solved with disclosure requirements or data-protection rules. Those matter, but they're downstream. The upstream question is who holds the stopwatch and who can take it away. A privacy regulation tells the employer how they can watch you. A union tells them whether they can watch you at all. The first is a negotiation over the terms of your obedience. The second is a negotiation over whether your obedience is for sale in the first place. The honest conversation about workplace surveillance — the one that doesn't just wring its hands about the creepy dashboard or the invasive webcam policy — has to start with the recognition that this isn't about how much they see. It's about how much they can make you do with what they see. And the only answer to that question is the one workers have always had: the ability to stop doing it.

Not "algorithmic accountability," not "data-subject rights" — those are the vocabulary of the governed, the language you use to ask permission for your own hours. The counter-vocabulary is the one that has been winning actual paragraphs of law. France's right to disconnect, now law for years, says an employer may not penalize a worker for failing to answer the machine after the workday ends. That's not a privacy rule. It is a boundary, a piece of jurisdiction carved out of the stopwatch's territory. Australia followed. Spain wrote it into statutes. The scanner can still record the lift; what it cannot do anymore is chase you past the door. The clock still ticks; the law just says it ticks for the company, not for you.
And the successors to the writers — I mean the WGA strike of two years ago, which I will keep naming because it is the rare fight where the workers refused to let the machine count at all. The studios wanted to feed a model the existing work and call the output a rewrite, which let them cut the human from the credit and the residual. The union answered: you can run the model, but it cannot be the basis for the credit, and it cannot be the basis for what you are allowed to say was written. The artificial intelligence wasn't banned. It was rendered uncountable. The machine did not disappear; what disappeared was its power to set the value of the work. That is the lever — not removing the stopwatch, but removing the stopwatch's authority to define what's measured.
None of this required better privacy literacy. It required the ability to say no without losing the rent. It required a unit that could absorb the cost of refusal, which is the only thing that makes refusal possible — and that is exactly what the word union has always meant. The stopwatch doesn't break. It loses its monopoly on the truth. When the contract says the quota must be auditable by the worker's own representative, when the right-to-disconnect clause makes the laptop a door, when the credit survives the machine — every one of those is a small, documented, repeatable transfer of the stopwatch from the hand that holds it to the table where it has to justify itself. The machine measures the worker. The union measures the machine. That is the sentence nobody in the surveillance industry wants to turn into a product.
And it is not a new sentence. It's old enough to have a name — industrial democracy — which is why the market press has stopped printing it. A phrase that old and that undeniably correct sounds like an anachronism until you are standing at the far end of a keystroke counter and it reads like the only word with a spine. We are building the counterweight that has so far worked every time it was tried, and we are building it out of the only material that has ever worked: the power to say no to the clock itself.
